Now, state can transfer teachers of govt-aided college
As per the gazette notification on West Bengal Colleges (Transfer of Employment ) Rules 2017, the state government can now be able to effect the transfer of teachers in government- aided colleges for the interest of public service. Earlier, the transfer of teachers were applicable only in case of government colleges.
"In some colleges there are dearth of teachers while in some cases there are teachers but not sufficient numbers of students. The grant of transfer is subject to the largest of maintaining a healthy and efficient higher education system. So why will the government not have the right to transfer for the sake of public interest?" Education minister Partha Chatterjee said. The new rule empowers the state to transfer teachers in three broad grounds: transfer of own seeking, mutual transfer and transfer in public interest. According to the new rule, an employee will be eligible for transfer of his own seeking only when he has been confirmed in service and has completed five years of satisfactory and continuous service in a college from which he seeks transfer. No application under transfer of own seeking shall be entertained if the employee concerned seeks transfer to a college situated within a distance of 25 km from present place of posting. "
A teacher in his teaching career can apply either for mutual transfer or for transfer of own seeking," a senior official of the Education department said.
Transfer for own seeking will also be applicable in case of a librarian and non teaching staff.
"Mutual transfer can be availed by two employees of different colleges, who have been appointed against the same category of posts in regard to all kind of employees and in case of teachers, holding a post having same or relevant subjects," the official added.
