SC asks Centre to consider allowing pregnant woman pushed into Bangladesh to re-enter India


PTI, NEW DELHI, DEC 1 2025: The Supreme Court on Monday asked the Centre to consider allowing a pregnant woman and her child, who were pushed into Bangladesh earlier this year, to enter India on "humanitarian ground" while being kept under "surveillance".

A bench of Chief Justice Surya Kant and Justice Joymalya Bagchi asked Solicitor General Tushar Mehta to seek instructions on allowing the woman, who is in an advanced stage of pregnancy, to enter India through the Indo-Bangladesh border at Malda in West Bengal.

Mehta sought two days' time, saying the government would examine the humanitarian aspect.

Senior advocate Sajay Hegde, appearing for Bhodu Sheikh, father of Sonali Khatun, said the family were waiting on the Bangladesh side to enter India and that their deportation had already been held illegal.

The bench said the Centre may consider allowing the pregnant woman and her child to enter India and keep her in a hospital to avoid complications.

Hegde added that her husband should also be allowed to enter, as he "can't be left behind".

The matter was posted for December 3.

The case arises from the Centre’s plea challenging a September 26 order of the Calcutta High Court, which set aside the deportation of Sonali Khatun, Sweety Bibi, and their families, calling the action "illegal".
