Death penalty for one under POCSO act for rape and rape and murder of 5-year old

The court also awards seven years of rigorous punishment to him for destruction of evidence

Praduman Choubey   |   TT  |  Dhanbad   : A Dhanbad court on Wednesday awarded death penalty under the Protection of Children from Sexual Offences (POCSO) Act  to Dablu Modi, a resident of Putki for rape and murder of a five-year girl of his neighborhood. The court also imposed a fined of Rs 12,000 on the accussed. 

The court which held Modi guilty for the crime on February 7, today pronounced the quantum of punishment, as per which he was awarded death penalty for the murder of the girl and also imposed a fine for Rs 11000 for the same offence. The court, meanwhile also awarded seven years rigorous punishment to  him for  destruction of evidence and also imposed a fine of Rs 1000 for the same.

Talking to media after the judgment, Anil Kumar Singh, Senior Public Prosecutor of Dhanbad said, “Dablu Modi who was arrested by the police after the incident was in judicial custody since then and he was awarded death sentence today."

He further said that Modi, who was a neighbour of the victim came to her house of April 28, 2018 and took her on the pretext of taking her to a marriage function scheduled that night in the colony. Being the next door neighbour, the victim’s mother allowed her to go along with Modi but as the girl didn’t return  home after four hours, her mother went to house of Modi searching her daughter.  Modi, who was lying at his house in highly inebriated condition, however failed to disclose anything.

Later, the victim’s mother along with the three other women of the locality carried out a whole night search for the girl but as she failed to find her, she lodged an FIR against Modi in  Putki Police station of April 29, 2018.

Police later carried out a search for the girl and found the dress and slippers on the bank of pond in the adjoining bushy area of Jamdiha in Putki. Police then arrested Modi and he during police interrogation accepted his guilt and divulged that he raped and killed the girl and lather threw away the dead body in the adjoining forest area. The dead body was later recovered by the police on the indication of Modi.
