Wepen, April 5, 2019: While the Bimal Gurung return drama was unfolding at the Bagdogra Airport on Thursday, Puran Tamang, a co-accused had moved the Calcutta High Court Circuit Bench, Jalpaiguri for anticipatory bail for 35 persons. The hearing of the same was deferred thereby ending chances of Gurung and Giri to make an appearance in the Hills to campaign for the BJP.
The next date of hearing has been fixed on April 22.
On Thursday as the hearing for the anticipatory bail plea started the PP Saikat Chatterjee prayed for deferment citing absence of some of the required documents pertaining to the case as the cause. The Division Bench of Justice Dipankar Dutta and Sivakant Prasad fixed the next date of hearing on April 22.
Tamang had applied for anticipatory bail for himself, Gurung, Roshan Giri and others for the case 190/17 of Darjeeling Sadar police station. All 35 are charged under Sections 120, 120B, 121,121B of the Indian Penal Code along with 18A and 18B of the Unlawful Activities Prevention Act (UAPA).
In this case 390 gm of power gel explosive had been recovered from one Rajani Rai. During interrogation Rai had revealed the names of the others. Based on this, Sections of UAPA had been slapped upon them.
As Mayukh Mukherjee moved bail plea on behalf of Tamang and the others, the PP objected stating that the case diary had not yet arrived and as it has not been possible to go through all the documents. On these grounds the PP had prayed for deferment.
“The next date of hearing is 22nd April,” stated Mayukh Mukherjee.
BP Bajgain, Spokesperson, GJM (Bimal faction) Spokesperson stated that legal experts are being consulted to decide on future course of action.
In another development Yogendra Pradhan and Rohan Rai, both from the GJM Bimal Gurung camp, who had been picked up by the police from Bagdogra Airport and taken away to Phansidewa, were released at night.
TT, 6 April 2019, Jalpaiguri: Gorkha Janmukti Morcha leaders Bimal Gurung and Roshan Giri filed anticipatory bail petitions before the circuit bench of Calcutta High Court in Jalpaiguri on Friday.
The pleas were filed by lawyer Urgen Lama on behalf of the Morcha leaders.
The Morcha duo sought bail in two cases, which were registered at Kurseong on December 15, 2018, and in Darjeeling on June 9, 2017.
The Supreme Court had on Wednesday directed Gurung and Giri to approach the high court for anticipatory bail.
