KalimNews: Response to GRC quits GJAC posted in kalimpongnews.net on August 28, 2013.As stated in preceding replies, Darjeeling hills merger in Sikkim maybe tempting to presume but presumption alone will not effect any substantial gain in effecting it. 
This for the simple reason now Sikkim is a distinct territorial administrative unit within the Union of India and therefore even considering the perceptive merger will be insurmountable proposition and therefore the need to reject it as chasing a shadow of the Sikkim of yester years.
This fact is further cemented by the Sikkim State Assembly passing a Govt. Resolution No. 3 of 2011 demanding Gorkhaland state for the hill people of the District, and quite rightly too, and having dispatched the draft resolution to the Centre. This is an indirect acknowledgement that while demanding a State for the people of Darjeeling District, also in reverse program indicating its inability to allow the District’s merger with Sikkim. So the resolution is like a two edged knife cutting off Darjeeling District from the State at the same time intended the District should not consider merger with Sikkim. So there you have it with a situation, heads or tail, whichever the toss depicts Sikkim is a winner.
Also added to the above impact of the Sikkim Assembly Resolution it requires to be observed that Darjeeling District was established as an administrative unit in 1867 with the inclusion of Kalimpong subdivision with Darjeeling (Kurseong & Siliguri) as acceded areas of Sikkim. Whereas Kalimpong has relevance as accede territory of Bhutan. So with this at the back of the mind it will be difficult to included Darjeeling District as a whole into Sikkim peculiarly because Kalimpong subdivision merger with Sikkim has no legal sanction. Hence the program is not possible for implementation.
While considering state formations of any kind in India all constitutional legalities require to be complimented without a flaw if the demand is to be effectively planked. As of the moment all statehood demand, according to this writer is now complete as far as the Constitution is concerned. That is after Telangana and Gorkhaland are finally created, totally as an aspect of the Fifth Schedule only. There is none other route. To console all the stakeholders  demanding a State for Darjeeling District it is one hundred percent confirmed that the aspirations of the people will eventually become a reality in form either as a UT if not a State. This is not a gypsy’s crystal ball picture but a well prepared investigative study into the legalities of statehood demand – constitutionally speaking.
