SC Says Deletion from Electoral Rolls Does Not Automatically End Welfare Benefits


MP, July 17, 2026, Kolkata : The Supreme Court observed that deletion of a person's name from the electoral rolls does not, by itself, deprive them of access to certain government welfare benefits, while asking a West Bengal resident to seek relief before the jurisdictional High Court regarding his ration card.

A three-judge Bench headed by Chief Justice of India Surya Kant, and comprising Justices Joymalya Bagchi and V. Mohan, made the oral observation while hearing a plea filed by Mohibulla Mondal.

He had sought the court's intervention to prevent the suspension or cancellation of his ration card after his name was removed from the state's voter list during the Special Intensive Revision (SIR).

During the hearing, the Bench indicated that issues relating to the continuation of welfare benefits could be effectively addressed by the High Court.

The court noted that removal from the electoral roll does not automatically extinguish a person's entitlement to benefits such as subsidised food under existing welfare schemes, if otherwise eligible.

Mondal informed the court that he feared losing his ration benefits following a June 4 communication issued by the state's Food and Supplies Department.

He also submitted that his challenge to the deletion of his name from the electoral roll is already pending before an appellate tribunal constituted pursuant to earlier directions of the apex court.

The Bench observed that if the tribunal eventually restores his name to the electoral roll, the dispute over the ration card may no longer survive.

It accordingly requested the appellate tribunal to make an effort to dispose of Mondal's appeal within the next two months, while leaving him free to pursue appropriate relief before the concerned High Court regarding his welfare entitlements.
