Nepal court rejects interim order in favour of RSP candidate NCP leader wins

PTI, March 15, 2026, Kathmandu :  The Supreme Court on Sunday refused an interim order against the decision of the Election Commission to cancel the candidacy of RSP leader Kishori Sah from Dhanusha constituency in the just concluded general elections in Nepal.

The court's denial to issue the interim order has also meant that Nepali Communist Party (NCP) leader Matrika Yadav won the March 5 election from Dhanusha 1 constituency in Madhesh province.

Sah, the Rastriya Swatantra Party (RSP) candidate for the House of Representatives election, had lodged a writ petition at the Supreme Court demanding cancellation of his candidacy by the Election Commission.

Sah's candidacy was cancelled as his name was included in a financial black list prepared by the Election Commission.

Though the RSP candidate received the highest number of votes during the Parliamentary election, a division bench of Justices Binod Sharma and Megharaj Pokharel on Sunday refused to give the order he sought.

With this, the Election Commission's decision on scrapping Sah's candidacy has been upheld and the Nepali Communist Party leader Matrika Yadav is victorious.

NCP won eight seats under direct election and with nine more seats under the proportionate voting, the party stood in fourth position with 17 seats in the 275 member Lower House.

RSP received as many as 182 seats but fell two short of getting a two-thirds majority.
