Supreme Court Declines to Interfere in West Bengal SSC Group C and D Recruitment Process
A bench comprising Justice Sanjay Kumar and Justice Alok Aradhe dismissed the plea, stating that the main case concerning the 2016 recruitment process had already been decided, and questioned the need for further petitions on the same issue. “No additional petitions will be heard. We have already cancelled the entire panel. In such a situation, why are fresh applications being filed on the same matter?” the bench remarked during the hearing.
The petitioners had argued that while the teacher recruitment process had a set timeline, there had been considerable delays in advertising vacancies for Group C and Group D posts. This lack of a time-bound schedule, they claimed, left aspirants uncertain about when the recruitment would actually take place.
In response, the Bench reiterated that the case regarding teacher appointments had already been settled in April, when the Supreme Court had cancelled the 2016 SSC panel and directed the state to complete the fresh teacher recruitment process by December 31, 2024. However, Monday's order clarified that this time-bound direction applied only to teacher appointments and did not extend to the recruitment of non-teaching staff.
The Bench also made it clear that if a new notification for Group C and Group D recruitment were issued, the petitioners would be free to approach the appropriate legal forum, but not directly before the Supreme Court. “You have the freedom to approach the High Court, but no further miscellaneous applications will be heard here,” the Bench added.
In summary, while the petitioners sought intervention to ensure a timely process for Group C and Group D recruitment, the Supreme Court's decision effectively closed the matter for now, stating that no further actions or petitions would be entertained on this issue at the national level. The Court also pointed out that any new developments or recruitment processes could be addressed at the state or High Court level, but the Supreme Court would not entertain repeated applications on the same subject.
