The bench dismissed appeals filed by a few candidates challenging a single bench order that had declined to entertain their objections against certain provisions of the 2025 recruitment rules framed by the West Bengal Central School Service Commission (SSC). The division bench, presided over by Justice Soumen Sen and also comprising Justice Smita Das De, had reserved its judgment on Monday after concluding arguments from all parties involved.
The petitioners had contested provisions related to the fixation of minimum marks in graduation or post-graduation required to qualify for the selection process, as well as changes in the pattern of mark allotment. However, the court upheld the validity of the new rules and dismissed the appeals.
With the appeals dismissed, the state government and the SSC are now permitted to proceed with the ongoing teacher recruitment process.
Advocate General Kishore Dutta, representing the state government, argued before the bench that the recruitment notification issued on May 30 was aligned with current educational standards and intended for the benefit of students. He emphasized that the changes were made as per legal requirements and reflected the evolving needs of the education system.
As per the court's earlier direction, the state government, the West Bengal Board of Secondary Education, and the SSC had on Monday submitted affidavits previously filed before the Supreme Court in connection with the school jobs case. That case had led to the cancellation of nearly 26,000 jobs due to a tainted selection process.
With this judgment, the path is now clear for fresh recruitment to fill vacancies in teaching posts across West Bengal schools under the revised 2025 rules.
