Autorickshaw Driver in Haflong Fined for 'Riding Without Helmet' in Bizarre Incident


AGENCIES & KALIMNEWS, HAFLONG (ASSAM), AUGUST 14: In a peculiar and unexpected turn of events, an autorickshaw driver in Haflong, Assam, was fined Rs. 1000 for "riding without a helmet by both driver and pillion," a charge usually associated with two-wheeled vehicles. The incident has sparked confusion and raised questions about the enforcement of traffic regulations in the region.

The incident came to light on Wednesday when Dinendra Kemprai, the owner-cum-driver of the autorickshaw, visited a pollution testing centre to renew his vehicle's pollution certificate. To his astonishment, Kemprai was informed by the attendant that a fine had been levied against his vehicle for a violation that typically applies only to motorcyclists.

"I have been driving my autorickshaw for the past seven years and have never been fined," Kemprai said, expressing his disbelief. "It shocked me when the pollution centre informed me that I needed to clear a fine for 'riding without a helmet,' even though my vehicle is a three-wheeler, which does not require a helmet."

Haflong Police Station falls under the jurisdiction of the Dima Hasao Police Administration in the Dima Hasao district of Assam. 

Kemprai, seeking clarification, approached the traffic branch of Haflong to inquire if a new rule had been implemented. However, his efforts to resolve the issue were stymied when he discovered that the officer-in-charge was not present in the office.

"My pollution certificate will expire on 15th August," Kemprai added, "and I don't understand what to do now. The police might ask for the pollution certificate, and I could be fined again."

The incident has also brought to light allegations from other drivers in the area, who claim that many policemen, especially those on duty at night, are often under the influence of alcohol. These drivers allege that they are frequently harassed in the name of routine checks.

The fine, dated July 29, 2023, was imposed by the then Officer-in-Charge of Haflong Police Station, Inspector Ranjit Saikia, and was witnessed by Assistant Sub-Inspector Mughani Sema. The challan issued to Kemprai’s vehicle, which is registered under the number AS08 8291, mistakenly classified his three-wheeler as a "Luxury Cab."

The incident has raised concerns about the accuracy and fairness of traffic enforcement in the region, and many are calling for a review of the procedures followed by local authorities. Kemprai’s situation highlights the broader issue of potential inconsistencies in the application of traffic laws, prompting a need for greater accountability and clarity in the system.
