High Court ordered to list the matter of GTA election on 23rd June- It also has ordered to enlist another case of Jalpaiguri Circuit Bench along with this matter





SC, KalimNews, 21 June 2022 : High Court will hear the matter of GTA election again on 23rd June.  It was hearing a case filed by Gorkha National Liberation Front (GNLF) praying  for a stay of the elections scheduled to be held on 26th June, 2022 and in the alternative a direction on the State not to give effect to such elections pending hearing of the constitutional challenge made to the Gorkha Territorial Administration Act, 2011, Justice Moushumi Bhattacharya of Calcutta High Court today ordered to hear the case again on 23rd June by stating "List this matter on 23rd June, 2022." 

In the order it is stated that "the Learned counsel appearing for the petitioners and the learned Advocate General appearing for the State along with learned Government Pleader and the learned Assistant Additional Advocate General are requested to give their respective short points in respect of the submissions made. Since the records of the case were not sent by the Department before this Court despite a requisition made yesterday, i.e. on 20th June, 2022, this matter is taken up for consideration and the order is passed on the papers given by learned counsel appearing for the parties."

Justice Bhattacharya also has added "List WPA 1171 of 2022, a matter of the Circuit Bench at Jalpaiguri, along with this matter on the returnable date."

In the case filed by GNLF and Anr (Other parties) against Union of India (UOI) and others vide WPA 12212 of 2012  With CAN 4/2022  (Original papers not in the file), it was heard today in Court no.5 Item No.17.

Learned counsels Mr. Subir Sanyal, Mr. Soumya Majumdar, Mr. Satarup Banerjee, Mr. Lokenath Chatterjee, Mr. Jyotirmay Adhikary, Mr. Sukanta Ghosh, Mr. Jasajeet Mukherjee, Mr. Satyanarayan Sharma, Mr. Sariful Haque and Mr. Ayan Dutta are for the petitioners.

Mr. S.N.Mookherjee, Ld. AG, Mr. Samrat Sen, Ld. AAAG, Mr. Anirban Ray, Ld. GP, Mr. Nilotpal Chatterjee, Mr. Debray Shaw, are for the state while Mr. Billwadal Bhattacharyya, Ld. ASG, Mr. Rudrajyoti Bhattacharyya, Ms. Debjani Ghoshal, are for the respondent of UOI.
