Supreme Court sets aisde HC order on Alapan case transfer

The Centre transferred Bandyopadhyay to New Delhi last year following his absence from a meeting chaired by PM Modi to review the destruction caused by a cyclone

TT Legal Correspondent   |   New Delhi   |  07.01.22  : The Supreme Court on Thursday set aside Calcutta High Court’s order that struck own the decision of the principal bench of the Central Administrative Tribunal in New Delhi to shift to the national capital from Calcutta last year a petition filed by then Bengal chief secretary Alapan Bandyopadhyay challenging his transfer by the Centre.

The Supreme Court bench of Justice A.M. Khanwilkar and C.T.Ravi Kumar said the high court has no jurisdiction over the principal bench of the CAT.

The Centre had transferred Bandyopadhyay to New Delhi last year following his absence from a meeting chaired by Prime Minister Narendra Modi to review the destruction caused by a cyclone.

While clarifying that it was not going into the row relating to the transfer of the now superannuated officer, the Supreme Court, however, deplored certain observations made by the high court against the CAT’s principal bench.

The Supreme Court said Bandyopadhyay could move Delhi High Court against the CAT’s decision to shift his petition from Calcutta.
