Darj bypolls: Warrant against Bimal, others

SANKHA GHOSH, SNS, SILIGURI. 14 MAY 2019: The Darjeeling Police has identified 103 "trouble makers" ahead of the by-elections for the Darjeeling Assembly seat. As part of the poll process, the police have also issued non-bailable warrants (NBW) against some persons, including fugitive leader of the Gorkha Jan Mukti Morcha (GJMM) Bimal Gurung. The elections for the Assembly seat are scheduled to be held on 19 May.
"We have identified 103 trouble-makers and police have started taking action against them so that they do not create problems during the elections. Police are keeping a close tab on them. Some of them were involved in skirmishes and named in FIRs, whiles some were identified as trouble-mongers during the parliamentary elections too." Darjeeling district Superintendent of Police, Amarnath K. said.
Non-bailable warrants (NBW) have also al ready been issued against 368. including Mr Gurung. "There are 207 persons against whom NBWs have be en issued," Mr Amarnath said. Police further said that the absconders wanted in Darjeeling in connection with arson and violence during a l04-day long shutdown in the Hills in 2017 had fled to Nepal.
Sources said Mr Gurung was last seen in the Hills at a programme to mark Independence Day at Ging tea estate in 2017. He has been on the run since then, as several cases have been slapped against him for his involvement in the violent agitation for a separate state of Gorkhaland around two years ago.He has also been booked under the Unlawful Activities (Prevention) Act.
Police officers said that apart from habitual offenders, warrants were also issued against some persons who were "long absconders" and who may have a "negative influence."
Mr Amarnath said police were taking preventive measures against such trouble-makers under Section 107 of the CrPC.
According to the Section, when an Executive Magistrate receives information that any person is likely to commit a breach of peace or disturb public tranquility or do any wrongful act, and is of opinion that there is sufficient ground for procealing, he/she may "in the manner herein after provided, require such person to show cause why he should not be ordered to execute a bond with or without sureties for keeping the peace for such period, not exceeding one year, as the Magistrate thinks fit.."
Police officers said such measures taken upon orders from the Election Commission were routine before elections.
"We prepare a list of habitual offenders and trouble-makers, based on instructions from the Election Commission and take steps to ensure that those trouble makers do not create trouble. As per the steps, according to Section 107, if they are found involved in trouble making despite the warnings, police will arrest them." said a police officer.
The district police has also identified 87 Vulnerable areas. During the previous Assembly elections in 2016, the figure was 63 in the constituency.
