Panchayat certificate no proof of citizenship: Supreme Court
PTI, NEW DELHI, DECEMBER 05, 2017 The Supreme Court on Tuesday held that a certificate issued by the Gram Panchayat secretary or the executive magistrate by itself was “no proof of citizenship” unless it established the legacy linkages with a person who was an Indian citizen.
The top court said the certificates issued by the Gram Panchayat secretary merely acknowledged shifting of residence of a married woman from one village to another.
A Bench of Justices Ranjan Gogoi and R.F. Nariman said “such proof will come only if the link between the claimant and the legacy person [who has to be a citizen] is established”.
The Court set aside the Gauhati High Court order, which made such certificates invalid, and allowed the appeals against the order to a limited extent. Various individuals and organisations had challenged the High Court order.
