Court rejects plea to adjourn hearing on Tamang murder case
The charges have to be framed against 48 accused on charges of murder and criminal conspiracy.
It may be mentioned that general secretary of Gorkha Janamukti Morcha (GJM) has pleaded before the Supreme Court to hold the hearing in this connection out of Kolkata. The hearing in the Apex Court is going to be held on August 8.
Submitting that the hearing in this connection in the Apex Court will take place soon, Debasish Roy, defence counsel, pleaded before the City Sessions Court to adjourn the hearing on framing of charges.
The CBI counsel, Arun Bhagat, opposed the plea of the defence counsel and submitted that the no stay order on the hearing on framing of charges has been given by the Supreme Court.
After hearing both the counsels, Chief Judge of the City Sessions Court, Kundan Kumar Kumai stated that the proceedings of the hearing would continue. He mentioned that the Supreme Court has not given any stay order in this connection. At the same time, the Calcutta high court ordered to complete the framing of charges by August 17.
The CBI counsel had also submitted before the court on Tuesday that how the GJM had forced Tamang to reschedule the meeting in Darjeeling in May 2010 as the victim wanted to bring to light the alleged corruption of senior members of GJM. Moreover, he was killed on May 10 in 2010 in Darjeeling just before the rally.
The counsel has also submitted about the evidences that the investigating agency have found about the alleged involvement of GJM leaders in the murder. It may be mentioned that four of the 54 accused had died and two are still absconding.
The CBI had served notice to 48 of the remaining accused to be present in the City Sessions Court on July 24. Though 26 of them were present, rest 22 including Gurung and his wife Asha Gurung didn't turn up at the court on that day.
