CBI to move HC challenging Gurung's release order

CBI to move HC challenging Gurungs release orderMP, 12 December 2017, Kolkata: The Central Bureau of Investigation (CBI) is set to move the Calcutta High Court challenging the order of the City Sessions Court in discharging Bimal Gurung from the Madan Tamang murder case. 
Tamang was murdered in broad daylight when he was busy supervising the preparation of a rally at Clubside in Darjeeling in May 2010. 
It was on August 17 that the City Sessions Court had discharged the then Gorkha Janamukti Morcha (GJM) chief Bimal Gurung from the All India Gorkha League (AIGL) leader Madan Tamang's murder case. 
The court had directed framing of charges against the 47 other accused in this connection including Gurung's wife Asha Gurung. 
It may be recalled that Gurung's counsel had submitted before the court that he was not in Darjeeling when the incident had taken place and he was in Kalimpong on the day Tamang was murdered. CBI's lawyer had then submitted that Gurung was involved in the conspiracy to murder Tamang. 
Challenging the City Sessions Court's order, Madan Tamang's wife Bharati Tamang has moved the Calcutta High Court and the application has been admitted by the court. 
Earlier, the CBI had also pleaded before the City Sessions Court to issue non-bailable warrant against Gurung and 21 others in this connection as framing of charges would not be possible without all the accused being present in the court.
